In no event shall Alumo or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption,) arising out of the use or inability to use the materials on Alumo’s Internet site, even if Alumo or a Alumo authorized representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.

The materials appearing on Alumo’s website could include technical, typographical, or photographic errors. Alumo does not warrant that any of the materials on its website are accurate, complete, or current. Alumo may make changes to the materials contained on its website at any time without notice. Alumo has not reviewed all of the sites linked to its Internet website and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by Alumo of the site. Use of any such linked website is at the user’s own risk.

Alumo may revise these terms of use for its website at any time without notice. By using this website you are agreeing to be bound by the then current version of these Terms and Conditions of Use.

8. Governing Law

Any claim relating to Alumo’s website shall be governed by the laws of the Republic of South Africa without regard to its conflict of law provisions.

9. Payment Options & Terms

1. Alumo Energy accepts the following payment methods:
   1. (EFT) Electronic Funds Transfer
   2. Cash Deposits – 2% bank levy applies
   3. No COD or Cheque payment options
2. It is your responsibility to ensure the products being purchased are appropriate for the purpose of intended use. If there is any doubt towards the suitability of a product, please contact us on our support email address/phone number for assistance prior to placing your order.
3. No order will be binding with Alumo Energy until it has been accepted by management
4. Payment for product/s ordered is due prior to shipment.
5. Where applicable, prices are quoted on the ruling day exchange rate and are subject to regular increases as a result of adverse changes in the exchange rate. Until such time as we have received payment in full, we reserve the right to charge any fluctuations to the client’s account and the client undertakes to pay for such fluctuations on demand. It is the responsibility of the client to check that there have been no changes in the price prior to attending to payment.

10. Shipping Charges

1. Your total cost for purchase of any product will include shipping and handling charges as reflected on the Alumo Shop website or invoice.
2. You undertake to effect payment as specified on the invoice presented to you and acknowledge that Alumo Energy may impose interest at the rate of 1.5% per month, on outstanding amounts, or the highest rate sanctioned by law, whichever is eminent.

11. Delivery

1. Any delivery note or waybill (copy or original) signed by you or person accepting delivery on your behalf and held by Alumo Energy shall be sufficient proof that delivery was made to you. Goods delivered must be checked in order to confirm that the goods delivered are in accordance with the order placed and are free from visible damage/defect. Any discrepancies and/or visible defects must be noted on the delivery note/waybill.
2. Alumo Energy reserves the right to split the delivery of goods ordered in the quantities and on the dates it decides with your prior consent, which consent shall not be unreasonably withheld.
3. Delivery of goods may arrive separately as they could be dispatched at different quantities/dates or weight, directly to your door for convenience.
4. Should you choose to engage a third party to transport the goods, you indemnify Alumo Energy against any claims of any category that may arise from such an occurrence.
5. Alumo Energy mandates that it will aim to meet delivery times, but shall not be liable for any loss or damage of whatsoever category which you may suffer as a result of any delayed delivery, unless the aforesaid has regard to circumstances within its reasonable control.

12. Pricing

1. Price, specifications and terms are subject to change, you are therefore requested to peruse the prices, specification and terms prior to placing any order. The purchase price will be the current price as appearing on Alumo Energy’s purchasing website http://shopalumo.co.za/
2. If prior to delivery of the goods, there is any increase in the cost of the product, or if any other taxes or duties are levied or any laws are propagated which directly or indirectly increases the cost thereof to the company, the company shall be entitled to increase the price of the goods by an amount equal to such increased cost, by giving you reasonable notice thereof.

13. Change of Orders

All orders and variations to orders are subject to these terms and conditions. Only variations/quantities to orders will be accepted by Alumo Energy. Notwithstanding the above, Alumo Energy may, at its sole discretion, elect to accept and act upon telephonic orders and any variations to orders. Alumo Energy however, reserves the right to refuse delivery or collection of any order until placed in possession of a written order form.

14. Cancellation of Orders

1. Requests for cancellation of an order, prior to delivery, must be submitted in writing to [email protected].
2. No refunds will, however, be provisioned on deposits in the event of cancellation for specially ordered or manufactured products.
3. Any order is subject to cancellation by Alumo Energy should the goods ordered become unavailable due to any cause beyond Alumo Energy’s reasonable control.

15. Processing Times policy

You can expect an order to be processed within approximately two(2) to three(3) business days, provided the items are in stock and the payment has been verified, therefore, Alumo Energy cannot guarantee same day shipping. Customers should also note that no orders will be processed on weekends and official public holidays.

16. Guarantees and Warranties

1. To the extent allowed by law, and notwithstanding any other provision of this agreement:
   1. Any goods supplied by the company shall be subject to the manufacturing company’s warranty;
   2. Products will conform to supplier warranties in place.
2. The warranty shall immediately be rendered null and void in the event of any of the following:
   1. Failure to use the products in accordance with instructions and specifications provided by the company;
   2. Should the product has been subjected to physical damage, abuse, misuse, alteration, neglect, tampering, improper maintenance, or has been serviced, repaired, installed by persons not possessing the necessary qualifications required to do so;
   3. The product is not returned with an invoice/verifiable method confirming/containing proof of purchase.

17. Returns

1. You may return goods in the following instances:
   1. Within 7 (seven) days of the transaction or purchase receipt on arrival if the transaction falls within the scope of Section 44 of the Electronic Communications and Transmissions Act. The aforementioned return policy excludes items contemplated in Section 42(2) of the aforementioned Act; or
   2. within the implied warranty period if the product is defective; or
   3. Within 15 (fifteen) business days, if Alumo Energy has made an error in delivery.
2. Notwithstanding the above, Alumo Energy shall not be required to accept the return of any goods, unless defective within the warranty period, if at your direction the goods have been:
   1. partially or entirely disassembled;
   2. physically altered;
   3. permanently installed, affixed or attached;
   4. Joined or added to or blended or combined or embedded within other goods or property.

18. Returns Procedure

1. Alumo Energy will not accept the return of any product without approval and a confirmation return receipt issued by Alumo Energy
2. Customers agree to take full responsibility for the cost of shipping/ delivery and insurance fee on matters of exchange to Alumo Energy. Alumo Energy will not refund shipping charges, unless an error in delivery was made by Alumo Energy
3. Customers agree that all returned products for replacement or refund will be fully complete, in a resealable condition, and will include the original packaging material, manuals, and other accessories provided by the company.
4. There shall be a 5% return charge (as per supplier/company charge) for returns due to the order being the fault of the consumer.
5. If any part/object of the returned product is missing, Alumo Energy will refuse to accept the return or may impose additional charges against you for the replacement of the missing part/object.
6. Alumo Energy may charge a reasonable fee should it be necessary to restore the goods in order to render it suitably fit for restocking.

19. Returns Procedure

1. No repairs will be handled by Alumo Energy. All manufacturing defaults will be handled directly through the manufacturers of the product.
2. Alumo Energy shall not be held responsible for any loss or damage of whatsoever nature which you may suffer as a result of any unforeseen matter or events.
3. All costs for shipping to the manufacturer will be at the client’s expense should the manufacturers not offer a call out or free shipping policy to cover the expense.

20. Limitation of Liability

1. To the extent allowed by law, you agree that Alumo Energy shall not be liable or held responsible to you or any other person or entity whatsoever in respect of any loss or damage:
   
   1. caused by or arising from any fact or circumstance beyond the reasonable control of Alumo Energy;
   2. which is consequential or incidental loss or damage; and/or
   3. Of whatever nature and however arising from or in connection with the supply of goods.

21. Service Address and Notices

For all purposes under this agreement including giving of any notice , the payment of any amount, the service of any process and for all other purposes arising from set agreement the customer hereby accepts the service address on initial set quotation as the address for goods or services of set quotation to be delivered or carried out. I.e no changes to set address on initial quotation can be made on acceptance.

22. Title and Risk of Loss

1. Alumo energy upon purchase of products can provide shipment at an additional charge at which the person purchasing takes responsibility for any damages or loss after set goods have been collected for delivery
2. Alumo Energy reserves a purchase money security interest in the goods until such time as all goods have been paid for in full. You agree to allow Alumo Energy to sign appropriate documents on your behalf to permit Alumo Energy to protect its purchase money security interest.

Roman’s Pizza Voucher Codes Terms & Conditions

• Vouchers can be redeemed at any of our stores in South Africa, when the order is placed and processed directly at the store.
• The voucher cannot be redeemed online, or through any 3rd party delivery services (MrD / UberEats etc.)
• One voucher per transaction is allowed.
• The voucher cannot be exchanged for cash, and no change can be given if less than the voucher value is spent.
• Vouchers can be used to purchase any menu item on the Roman’s Pizza Menu. Should the purchase (order value) exceed the voucher amount, the balance due will need to be paid in by the customer

 

Voucher Processing procedure at store level

• The Customer will need to show the voucher code to the cashier at the store when the order is placed and ready to be processed.
• It’s important to note that the customer must indicate at the start of the order process, that they wish to apply their voucher.
• Vouchers will only be accepted if provided in the official format that the customer received the voucher.
• The cashier will process the order and apply the voucher as payment at the point of sale at the store.
• If the voucher value is for example R250, and the order total is R280 – the remaining balance due must be paid by the customer with cash or card.
